1. Acceptance of Terms

By accessing and using the Kindred Mind mobile application and website ("Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you and Kindred Mind.

2. Description of Service

Kindred Mind is an AI-powered journaling application that provides personalized conversations and guided prompts for self-reflection and personal growth. The Service includes access to AI assistants, journaling features, and insights analytics.

3. User Accounts

You must be at least 13 years old to use this Service
You are responsible for maintaining account security
You must provide accurate and complete information
You are responsible for all activities under your account
You must notify us immediately of any unauthorized access

4. Subscriptions, Billing, and Payments

When you purchase a subscription for our Pro Plan, your payment is processed by a third-party payment provider depending on the platform you used to subscribe. This may include the Apple App Store, the Google Play Store, or our third-party payment processor for web-based purchases (e.g., Stripe).

Billing and Automatic Renewal

Your Premium Plan subscription will automatically renew at the end of each billing period unless you cancel it. Payment will be charged to the payment method associated with your account on the respective platform (e.g., your Apple ID, Google Account, or credit card on file).

Managing and Cancelling Your Subscription

You are solely responsible for managing and cancelling your subscription. To avoid being charged for the next billing cycle, you must cancel your subscription through the original platform you used to purchase it at least 24 hours before the renewal date.

For iOS: You must manage and cancel your subscription in your Apple ID Account Settings on your device or through the App Store.
For Android: You must manage and cancel your subscription through your Google Account settings in the Google Play Store.

Deleting the Kindred Mind app from your device will not cancel your subscription.

Refunds

All payments are non-refundable and there are no refunds or credits for partially used subscription periods. All billing, payment, and refund inquiries are managed by the respective payment provider (Apple, Google, or our web payment processor). We do not have the ability to process payments or issue refunds directly for purchases made through mobile app stores.

Price Changes

We reserve the right to change our subscription prices. We will provide you with reasonable prior notice of any price changes. Your continued use of the Pro Plan after a price change becomes effective constitutes your agreement to pay the new price.

Taxes

All listed subscription fees are exclusive of applicable taxes, levies, or duties. Such taxes will be added to your subscription fee by the payment provider as required by law.

5. Acceptable Use

You agree not to:

Violate any laws or regulations
Harass, threaten, or abuse others
Share inappropriate or harmful content
Attempt to hack or compromise the Service
Use the Service for commercial purposes without permission
Impersonate others or provide false information
Use the Service as a substitute for therapy, counseling, or medical intervention
Rely on AI-generated advice for financial decisions or investments
Follow unusual, harmful, dangerous, or illegal suggestions from AI assistants
Use the Service if you are experiencing a mental health crisis or emergency
Hold us liable for any actions you take based on AI-generated content

User Responsibility

You are solely responsible for reading, understanding, and critically evaluating all AI-generated content. Do not blindly follow AI suggestions. Use common sense and seek professional advice when needed. We are not liable for any consequences resulting from your actions, decisions, or interpretations of AI-generated content, regardless of how extreme or harmful those consequences may be.

6. AI Content and Liability

Our AI assistants generate responses based on algorithms and are not human professionals. By using our Service, you acknowledge and agree that:

AI-generated content is for informational and self-reflection purposes only
We make no warranties about the accuracy, completeness, or suitability of AI responses
You should not rely solely on AI suggestions for important life decisions
We are not liable for any consequences resulting from following AI-generated advice
Our AI does not train on your personal data or journal entries

7. Intellectual Property

The Service and its content, features, and functionality are owned by Kindred Mind and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your journal entries
We retain ownership of the AI technology and app features
You grant us license to use your data to provide the Service

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

9. Limitation of Liability

To the maximum extent permitted by law, Kindred Mind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service or any AI-generated content. This includes but is not limited to any harm, injury, or illegal activities that may result from following AI-generated advice or suggestions.

10. Termination

Either party may terminate this agreement at any time
We may suspend or terminate accounts for violations
Upon termination, your right to use the Service ceases
Certain provisions survive termination

11. Data Rights and Requests

In accordance with data protection laws (including GDPR and CCPA), you have specific rights regarding your personal data stored by Kindred Mind. To exercise these rights, you must email our support team from your registered email address:

Processing Time: All data requests are processed within 30 days. Account deletions are completed within 7 days of confirmation. You must send these requests from your registered email address for verification purposes.

12. License to Use Our Service

Subject to your compliance with these Terms, Kindred Mind grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Kindred Mind application on a device that you own or control. This license is granted solely for your personal, non-commercial use of the Service.

13. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Kindred Mind expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

14. Indemnification

You agree to indemnify, defend, and hold harmless Kindred Mind and its affiliates, officers, agents, and employees from and against any claim, demand, damages, costs, and liabilities, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Vancouver, British Columbia, Canada to resolve any dispute or claim arising from these Terms.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the Service constitutes acceptance of modified Terms.
